These Terms & Conditions (the “Terms”) govern your access to and use of our website at jesuisjeanette.com and jeanette-crutchfield.com (the “Site”) and any content, newsletter, products, and services we offer (together, the “Services”), provided by Je Suis Jeanette (“we,” “us,” or “our”). By accessing or using the Site or Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or Services.

1. Who We Are & What We Offer

Je Suis Jeanette is a personal-growth brand. We share written reflections and articles, a free newsletter (“The Je Suis Letters”), a blog, and digital products such as guided journals and other downloadable resources. Our purpose is to offer perspective, encouragement, and tools for self-discovery.

4. Your Account & Subscriptions

If you subscribe to our newsletter or create an account, you agree to provide accurate information and to keep any login details secure. You are responsible for activity that occurs under your account. You may unsubscribe from our newsletter at any time using the link in any of our emails.

By using the Site or subscribing, you consent to receive communications from us electronically, such as emails and newsletters, and you agree that these satisfy any legal requirement that communications be in writing. You may opt out of marketing emails at any time.

6. Purchases & Digital Products

6.1  Products. We may offer digital products for purchase, such as guided journals and downloadable resources (“Products”).

6.2  Payment. Prices are shown at the point of purchase. Payments are processed by our third-party payment processor, [Square]. We do not store your full payment-card details; those are handled by the processor under its own terms and privacy policy.

6.3  Delivery. Digital Products are delivered electronically - typically by immediate download or an access link after purchase. It is your responsibility to download and save your Products.

6.4  License. When you purchase a digital Product, we grant you a limited, personal, non-exclusive, non-transferable license to use it for your own personal, non-commercial use. You may not copy, share, resell, redistribute, sublicense, or create derivative works from any Product without our prior written permission.

6.5  Refunds. Because our Products are digital and delivered instantly, all sales are final and non-refundable, except where a refund is required by law. We may ask for feedback and reserve the right to decline requests we reasonably believe are abusive.

7. Intellectual Property

All content on the Site and within our Products - including text, articles, journals, graphics, logos, images, designs, the “Je Suis Jeanette” name and branding, and the selection and arrangement of all of it - is owned by Je Suis Jeanette or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license granted in Section 6.4, you may not use, copy, reproduce, modify, distribute, publish, sell, or otherwise exploit any of our content without our prior written permission.

8. Feedback & Submissions

If you send us ideas, feedback, suggestions, or other submissions (for example, through our feedback form or by email), you grant us a non-exclusive, royalty-free, perpetual license to use them to operate and improve our Services, with no obligation or compensation to you. Please do not send us anything you consider confidential.

You agree to use the Site and Services lawfully and respectfully. You will not misuse, disrupt, or attempt to gain unauthorized access to the Site; use our content in violation of these Terms; or use the Services to harass, harm, or infringe the rights of others.

10. Third-Party Links & Services

The Site and Services may rely on or link to third-party platforms and websites we do not control - including our website and email platform, Ivorey, and our payment processor, Square. We provide links and integrations for convenience and are not responsible for the content, policies, or practices of third parties. Your use of any third-party service is at your own risk and subject to that party's terms.

11. Disclaimers (“As Is”)

To the fullest extent permitted by law, the Site, content, and Products are provided “as is” and “as available,” without warranties of any kind, whether express or implied - including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. This Section applies in addition to the Important Disclaimer in Section 2.

12. Limitation of Liability

To the fullest extent permitted by law, Je Suis Jeanette and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the Site, content, or Products. To the extent we are found liable, our total liability will not exceed the amount you paid us (if any) for the Product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Je Suis Jeanette and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or your violation of these Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved by binding arbitration in California, and you and we waive the right to participate in a class action.

We may update these Terms from time to time. Changes take effect when posted, with an updated “Last Updated” date. Your continued use of the Services after changes are posted means you accept the revised Terms.

16. Termination

We may suspend or end your access to the Site or Services at any time, for any reason, including a violation of these Terms.

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a transfer of our business.
